Terms and conditions
Last updated October 23, 2026
These terms govern the use of Wincall, Wincall SpA’s voice agent platform for sales, follow-up and collections. They apply together with the offer and terms accepted for each purchase.
1. Service provider and contact
Wincall SpA provides the service at trywincall.com. For support, subscriptions, billing or complaints, email [email protected]. The Privacy Policy explains how we handle data about accounts and the people contacted.
Visiting our website, selecting an offer or creating an account does not make a purchase or authorize charges. The stated terms of the offer and any terms disclosed and accepted at purchase must be honored. This page does not waive any rights that cannot be waived by law.
2. What Wincall does
The service lets you set up companies and agents, import contacts, prepare campaigns, place AI-powered phone calls and manage results, tasks, agreements or payment links according to the features available to you.
Availability depends on the country, call type, eligible phone numbers, calling hours, resources and providers. We do not guarantee universal coverage, unlimited service, a particular number of sales or debt recovery. Commercial examples are illustrative.
3. Accounts, permissions and authority
The person subscribing must have the legal capacity and authority to represent the company. The administrator manages team access. Each person must protect their credentials and act within their permissions.
The company is responsible for the accuracy of the contacts, debts, products, instructions, negotiation limits and authorizations it supplies. Configuring a campaign or uploading a contact list does not establish that the data is lawful or itself authorize recording or calling.
4. Lawful contact, recording and transparency
Before launching a campaign, verify the lawful basis for contacting people and processing data, applicable notices and consents, opt-outs and the limits in the destination country. Identify the company, explain the purpose and follow the rules for AI use and call recording.
The agent processes the conversation using AI and produces audio, a transcript and results. It must never be used to impersonate someone, unlawfully conceal who initiated the call, or represent an unverified claim as fact.
Our calling-hour and frequency limits are operational controls. They do not certify that each campaign complies with the law. Account for outreach outside Wincall and keep opt-outs and restrictions up to date.
5. Rules for contacting people in Chile and elsewhere
In Chile, requests to stop advertising and the No Molestar mechanisms must be respected. Where consumer rules apply to out-of-court collections, follow the limits on contact frequency and hours and respect dignity and confidentiality. Do not disclose debts to unrelated third parties or simulate court proceedings.
Under the Chilean rules described here, collections allow one call or visit per week and up to two additional contacts by other means, at least two days apart, on applicable business days and during permitted hours. Do not apply these limits separately to each tool or campaign when the rule covers all collection activity together.
Phone numbers must be eligible for the communication type. Subtel rules distinguish requested informational or support calls from unsolicited mass communications. Out-of-court collections have separate rules. A number enabled for one use may be ineligible for another campaign.
For other countries, check the rules on telemarketing, collections, recording, data protection and opt-out lists. Launch a campaign only if the available configuration and numbers can meet those requirements.
6. Instructions, agreements and human review
Before confirming a campaign, review its goals, amounts, products, conditions, discounts, installments, recipients and rules. The agent can take actions and propose agreements within the configured limits. That delegation does not authorize commitments outside the campaign.
AI can misunderstand responses or make mistakes. Review the results, handle escalations and verify information before making decisions that affect people. A claim that a payment was made is different from confirmation by the payment provider.
Pausing or ending a campaign prevents new activity under the workflow. It does not retroactively cancel an already connected call, an agreement or a completed payment. Check the status of any activity still in progress.
7. Free trial
The trial starts when you complete account onboarding for the first time. It ends after 30 days or 60 minutes of use, whichever comes first. No card is required and the trial does not start a paid subscription on its own.
The trial allowance is limited and does not increase when you add companies, calls or campaigns. The same country, numbering and calling-hour controls apply. Registration does not guarantee a call to a specific number if that number fails the operational requirements.
Any later subscription is confirmed separately. If you authorize a future charge, its date must be disclosed. Expiration of a trial without payment authorization does not trigger a paid renewal.
8. Plans, minutes and additional purchases
Each company subscribes to a monthly or annual plan, depending on the available offer. All plans in the current public offer share the same features and differ mainly in their included minutes. The terms accepted at purchase specify the allowance and coverage.
Minutes are used based on recorded call duration, regardless of whether a sale or collection succeeds. Resources may be reserved for calls in progress. A reservation is separate from final usage. The application shows the remaining balance and usage limits.
Included minutes are available in monthly windows, including on annual plans, and do not accumulate indefinitely. Available additional purchases are confirmed in separate transactions and are valid for 12 months from approval, subject to the purchase terms.
Subscribing to a plan does not in itself authorize overage charges, automatic top-ups or unlimited additional charges. Each additional authorization must disclose its price, scope and limits. Purchasing resources does not remove access, country or numbering requirements.
9. Prices, currencies and plan changes
Reference prices are shown in USD. The current Mercado Pago checkout charges in CLP. Before payment, the total, currency, billing frequency, applicable taxes or charges and relevant dates must be shown. The transaction is governed by the amount disclosed and accepted.
Automatic renewal requires authorization. A pending attempt or a checkout return page does not confirm payment. Confirmation comes from the provider. Declined payments do not grant new coverage or resources.
Upgrades may incur an immediate prorated charge. Downgrades or billing interval changes may take effect at renewal. The workflow must disclose the amount, resources and dates before acceptance. Updating the website does not change terms already agreed to.
10. Customer payments through Mercado Pago
Wincall subscription fees are separate from payments your customers make for sales or collection agreements. Those customer payments use the merchant’s Mercado Pago account and require an authorized connection.
Wincall records agreements, links and verified payment statuses. This does not make Wincall the creditor, guarantor, bank or recipient of funds on the merchant’s behalf. Fees, settlements, disputes and payment conditions also depend on the merchant’s relationship with Mercado Pago.
Protect your credentials and disconnect the integration when it is no longer authorized. A conversation or payment link does not prove that funds were received. Discrepancies, refunds and chargebacks require reconciliation.
11. Cancellation, account closure and retention
An administrator can cancel plan renewal under Subscription in Business Settings. Paid coverage continues until it expires, subject to adjustments for a verified reversal. Once coverage ends, features and resources that require active access may become unavailable.
Canceling renewal does not delete data or close the account. Deleting an account in the current workflow permanently revokes access and removes the applicable companies from operation while retaining identities, payments, tasks and history. You may need to cancel an outstanding renewal authorization with the provider before closing the account.
Requests to erase personal data are handled through the privacy contact, subject to retention obligations. Cancellation does not automatically purge contacts or recordings.
12. Right of withdrawal, errors and refunds
If consumer protection law applies to you and its conditions are met, you can withdraw from a distance contract within 10 days and before the service is provided. These terms contain no blanket exclusion. Email [email protected] with the transaction reference.
Canceling renewal does not itself trigger a prorated refund for time already used. Rights concerning improper charges, duplicate charges, breach and other legal grounds still apply. You can ask support to review these matters.
A verified refund or chargeback may reduce resources or coverage funded by the affected payment while retaining history and unrelated purchases. A dispute over a Wincall subscription is separate from a refund for a purchase from the merchant.
13. Intellectual property and prohibited uses
You retain rights to the material you provide and authorize processing only as needed to provide the lawfully requested features. Third-party data and recordings are not freely distributable. The software, brand and interface remain with their respective owners.
Prohibited uses include fraud, threats, harassment, unlawful discrimination, impersonation, simulated court actions, disclosure of debts to third parties, malicious uploads, unauthorized access and circumvention of opt-outs or controls.
We may restrict access or a feature to the extent warranted by abuse, security risk or legal requirements. Where appropriate, we will give the reason and explain how to request review, respecting the user’s rights and the provider’s obligations.
14. Availability and liability
The service depends on phone networks, connectivity and voice, AI, storage and payment providers. Failures, limits, blocked numbers and discrepancies can occur and may require review. Technical controls cannot guarantee an accurate conversation or commercial result.
Each party must handle incidents in accordance with its obligations. Nothing here excludes liability for a party’s own obligations, unlawful processing, willful misconduct, gross negligence or other matters that cannot lawfully be limited. Applicable legal remedies remain available.
15. Changes and complaints
We publish changes with their effective date. Material changes to a subscription will be communicated through the account or contact channels and require acceptance where applicable. Changes do not retroactively extend consent or authorize charges other than those accepted.
Chilean law governs, subject to any mandatory rules of the user’s or recipient’s country that apply. For questions and complaints, email [email protected]. You retain the right to contact SERNAC, the competent authorities or the courts provided by law.
